Standard Terms and Conditions

  1. The standard terms and conditions apply to all agreements made with Lauxtermann Advocaten BV however named and regardless of the nature. Variations from these terms and conditions are binding only if explicitly agreed in writing.
  2. The standard terms and conditions have been made for the benefit of Lauxtermann Advocaten BV, its staff and any other individuals engaged in the agreements made with Lauxtermann Advocaten B.V., for whose actions or inactions the firm could be liable.
  3. All agreements are accepted by Lauxtermann Advocaten BV. only. The applicability of Section 7:404 and Section 407.2 Dutch Civil Code are hereby expressly excluded.
  4. Lauxtermann Advocaten BV provides services based on hourly rates to be determined every year, increased by 6% office costs and turnover tax. The rates determined every year will apply to all services provided in that year.
  5. Lauxtermann Advocaten BV invoices on a monthly basis. The term for payment is 14 days of invoice. After expiry of that term, Lauxtermann Advocaten BV will claim commercial interest at the statutory rate, extrajudicial costs and procedural costs, with a minimum of EUR1,000.
  6. In all events will the liability of Lauxtermann Advocaten BV, its staff and other individuals engaged in the agreements made with Lauxtermann Advocaten BV or for whose actions or inactions the firm would otherwise be liable, limited to the respective amount paid under the liability insurance of Lauxtermann Advocaten BV, plus the amount of the excess payable by Lauxtermann Advocaten in that particular case.
  7. If for whatever reason no payment is made under the liability insurance, any liability will be limited to three times the amount invoiced by Lauxtermann Advocaten BV in that particular case, up to EUR50,000 maximum.
  8. Lauxtermann Advocaten BV has the right to accept on behalf of the client any liability limitations and other terms and conditions of third parties engaged in the execution of a contract. Any liability of Lauxtermann Advocaten BV for shortcomings by third parties will be limited to the amount that the client could have received in the event of a direct claim against that third party.
  9. All agreements with Lauxtermann Advocaten BV are subject by Dutch law. The Court of Amsterdam has exclusive jurisdiction over any disputes related to agreements made by Lauxtermann Advocaten BV. However, if Lauxtermann Advocaten BV is the claimant, it may file proceedings with a foreign court appropriate for the client.
